PLEASE READ CAREFULLY AND THOROUGHLY THE ENTIRE TERMS AND CONDITIONS OF USE, AS WELL AS THE ATTACHED PRIVACY POLICY, BEFORE UTILIZING ANY FEATURE AND/OR SERVICE AVAILABLE ON THE Ai Care PLATFORM.

The Terms and Conditions of Use ("Terms of Use") constitute a binding agreement governing the procedures and requirements for utilizing the features and/or services of the Ai Care Platform ("Platform") between the user ("You") and the Platform Operator, PT Atmatech Global Informatika ("We"). By downloading, installing, and/or using the Platform and/or availing of Our Services, You acknowledge that You have read, understood, acknowledged, accepted, and agreed to all the information, terms, and conditions of use of the Platform contained in these Terms of Use. Please note that the Terms of Use and Privacy Policy may be updated from time to time, and You are deemed to agree to all changes related to the Terms of Use and Privacy Policy.

If You do not agree with any part or entirety of the contents of these Terms of Use and Privacy Policy, You may delete the Platform from Your electronic device and/or refrain from accessing the Platform or using Our Services.

 

1. General Terms 

  1. Platforms include applications (Android or iOS versions), web applications (accessible via the web), and websites maintained by us, which are updated periodically.
  2. You need an internet connection to use the Service, and the costs related to internet usage are entirely borne by you.
  3. The Platform serves as a means to connect you with third parties who provide services or sell goods to you, such as (but not limited to) doctors, psychologists, pharmacies, laboratories, and delivery services ('Service Providers').
  4. The types of services that can be accessed through the Platform include:
    • Doctor Consultation;
    • Self-Symptoms Checker (Katherine);
    • Health Articles; and
    • Other services that we may add from time to time, are referred to as 'Services'.
  5. The web app is a feature that allows you to access some of our services without the need to download an app ('Web App').
  6. The platform is designed to facilitate the discovery of services where we collaborate with healthcare providers, pharmacy services, and delivery providers.
  7. We may use third-party services for payment processing. In the event of a payment system failure, we will make our best efforts to assist in resolving any issues that may arise. Your chosen banking/payment service provider may impose additional charges for their services.
  8. Katherine is an AI-based self-symptom checker developed and regularly updated by a team of doctors and technicians. Katherine's main goal is to help people quickly identify symptoms and understand potential illnesses. By doing so, Katherine aims to prevent self-diagnosis and self-medication and reduce guesswork related to symptoms. It is important to note that the analysis results provided by Katherine should always be consulted with a physician.
  9. The Platform allows you to submit service requests to service providers. Each service provider has the discretion and authority to accept or reject your request. If your request is accepted, the Platform will notify you and provide information about the service provider, including the order number and the option to contact them by phone.
  10. Any features or functionalities within the Platform may be updated or changed as necessary and as the Platform develops.
  11. You can provide information regarding personal data and medical history, which we will store and display in your account. We guarantee the confidentiality of your data, which will only be used by us and/or service providers to interact with doctors, order medicine, and other services available on the Platform, per your consent, applicable legal provisions, and our Privacy Policy.
  12. By using the Platform, you acknowledge and agree that conversations through video calls, voice calls, and chat features will be automatically stored and archived for legal purposes and service quality improvement. The confidentiality of your conversations is guaranteed, and information will not be disclosed to other parties.
  13. You understand and agree that your conversations with our Customer Service will be automatically stored and archived for legal purposes and service quality improvement. The confidentiality of your conversation is guaranteed, and the information will not be disseminated.
  14. You understand and agree that your communications with the healthcare facility connected through the phone number on our website will be automatically stored and archived for legal purposes and service quality improvement. The confidentiality of your conversation is guaranteed, and the information will not be disseminated.
  15. We reserve the right to stop or limit the registration process or your use of the Platform if there is a violation of these Terms of Use or applicable laws and regulations.

 

2. Terms of Use

  1. You represent and warrant that you are an individual with the legal capacity to enter into a binding agreement under the laws of the Republic of Indonesia. Furthermore, you affirm that you are at least 21 (twenty-one) years of age or married, and not under guardianship or curatorship. If you are under 21 (twenty-one) years of age and unmarried, you also declare that you have obtained consent from your parents or legal guardians, unless otherwise stated. By granting consent, your parents or legal guardians agree to be responsible for:
    • All your actions related to access and use of the Platform and/or services; 
    • Any fees associated with your use of any services; and
    • Your compliance with these Terms and Conditions.
  2. We reserve the right to close or cancel your account if this statement is found to be untrue. Furthermore, you represent and warrant that you have the right, authority, and capacity to use this service, and will always comply with the Terms of Use. If you are registering an account on behalf of a business entity, you also declare that you have the authority to act on behalf of the legal entity and to bind the legal entity to the Platform's Terms of Use.
  3. You may access certain features on the Platform without prior registration.
  4. To utilize all features on the Platform, you must register by providing legally accountable personal data as requested by the Platform (Personal Data). The information you provide will only be used by us and/or service providers to deliver services within the Platform and for other purposes you have agreed to, under applicable laws and regulations. The attached Privacy Policy (as updated from time to time) is an integral part of these Terms of Use.
  5. After successfully registering on the Platform, you will have a personal account that can be accessed using a One-Time Password (OTP) sent to your mobile phone number. We advise against sharing, transferring, or permitting others to use your identity or account. You are responsible for maintaining the confidentiality of your account password and any identifiers related to your account or personal data. If your password is disclosed for reasons beyond our fault, and this results in unauthorized or unlawful use of your account or data, any transactions or service orders made through the Platform will still be considered valid, unless you have informed us before the service provider delivers the requested services.
  6. You are responsible for any use of your account within the Platform. If you lose control of your account for any reason, you must report it to us immediately. If misuse of the account occurs before the report is made, you will be held accountable for any use of the account during that period.
  7. It is strictly prohibited to submit pornographic content outside the context of medical consultation, threats, verbal abuse, advertising or promotions, hate speech, annoying questions, abuse, modify or change the Platform in any way. Violation of these Terms of Use may result in the closure or cancellation of your account, as well as a ban on further use of the Platform.
  8. By using the platform, you understand, agree to, and are bound by our Privacy Policy, which may be updated periodically.
  9. You may only use the platform to obtain services and must not engage in illegal activities such as money laundering, theft, embezzlement, terrorism, or fraud. You also agree not to place false or unlawful orders through the platform.
  10. By providing information to us, you agree that the information you provide may be used by us and our service providers.
  11. You acknowledge and agree that all information in any form, including video, audio, images, or text present on the Platform, is protected by Intellectual Property Rights (including trademark and copyright) of their respective owners. You are not permitted to use, modify, distribute, disseminate, or misuse such intellectual property rights without the permission of the intellectual property owner, under applicable laws and regulations.
  12. When accessing and using the Platform, including all its features and services, you are not permitted to:
    • Transfer your account on the Platform to another party without prior approval from us.
    • Disseminate viruses, spam, or other similar technologies that may harm or adversely affect the Platform and other users.
    • Insert or transfer features onto the Platform without our authorization.
    • Place information or applications that infringe upon the intellectual property rights of others within the Platform.
    • Extract or collect personal data from other Platform users, including email addresses, without their consent.
    • Use the Platform for purposes that contravene applicable laws and regulations.
    • Use the Platform to distribute advertisements or other materials.
  13. You can delete your account from the Platform, but it will take 90 calendar days to reactivate your account.
  14. You acknowledge and agree that the service rates listed on the Platform may change.
  15. All health articles provided by us are intended for user education and do not substitute for medical advice, diagnosis, or treatment from our partner doctors.
  16. The medication information we display is general and aligns with the details provided on the medication packaging.
  17. The Platform contains links to websites operated by third parties. These links are provided for your convenience and solely intended to grant access to third-party sites, and not for any other purpose. The quality, content, or information about products or services is entirely provided by the third-party sites.

 

3. Services

  1. Doctor Consultation Feature
    1. This feature allows our partner doctors and/or psychologists, as service providers, to interact with you through video, voice, or chat calls accessible through the app.
    2. You can contact our partner doctors and/or psychologists when they are online.
    3. You can cancel your scheduled consultation (booking chat) with our partner doctors or psychologists up to 45 minutes before the scheduled time. The refund process for booking chat cancellations will be carried out under applicable procedures.
    4. Our partner doctors or psychologists can cancel a scheduled consultation (booking chat) up to 30 minutes before the consultation time starts. The refund process for canceling the booking chat will be carried out under applicable policies.
    5. If you do not attend the scheduled booking chat that you have chosen, you agree that the fees you have paid cannot be refunded.
    6. If our partner doctor or psychologist does not show up within 5 minutes after the scheduled booking chat, we will refund your fee under the applicable policy.
    7. We will notify you of your appointment via 'Push Notification' on your electronic device and/or via registered email. To receive notifications, you must enable this feature on your electronic device.
    8. You acknowledge and agree that this feature cannot replace a direct consultation with a doctor or a face-to-face meeting.
    9. We will do our best to ensure that partner doctors registered on our application and/or website can respond to your questions immediately. However, we do not recommend using this Platform for emergency medical situations.
    10. Our services are voluntary and non-binding. The decision to use this service is entirely yours. Our platform acts as a facilitator of interactions between partner doctors registered with us as service providers.
    11. You are expected to provide complete, clear, and accurate information about the symptoms or physical complaints you experience when communicating with our partner doctors through the Doctor Consultation feature.
  2. Self-Symptoms Checker Feature (Katherine)
    1. Katherine is an AI-based self-symptoms checker feature developed and regularly updated by a team of doctors and technicians. This feature aims to enable people to recognize their symptoms more quickly and precisely, thus avoiding inaccurate self-diagnosis. The results of Katherine's analysis are always recommended to be further discussed with the doctor.
    2. You acknowledge and agree that this feature does not replace direct medical examination and treatment by a doctor.
  3. Health Articles
    1. Through our Platform, you can access and read health articles that have been edited and reviewed by our team of doctors.
    2. You understand that these articles are provided to educate about health and the medical field. It is important to remember that they are not intended to replace direct medical advice, diagnosis, or treatment from a doctor.

 

4. Your Transaction

  1. To conduct transactions on the platform, you may use the various payment methods available. 
  2. Your Ai Care Wallet balance is non-transferable and cannot be converted into cash in any form. 
  3. The maximum balance of your Ai Care Wallet is Rp.2,000,000 (Two Million Rupiah).
  4. If you suspect any unusual activity or encounter any disputes regarding your account, you should immediately contact us to take the necessary actions.
  5. You can submit a refund to us, the claim can be submitted a maximum of 7 (seven) calendar days since you submit sufficient supporting evidence. In such a case, we will process the refund based on the results of our review of the claim.
  6. We can refund your money to the same payment source.
  7. We may suspend any transactions originating from your account and suspend transactions if we identify an issue with your account or a specific transaction.
  8. You understand and agree that the time limit for submitting a complaint regarding a transaction is a maximum of 7 (seven) calendar days after the transaction is completed.

 

5. Transaction Terms

Doctor Consultation Feature 

  1. You will be charged a certain fee for using the Doctor Consultation service.
  2. If you require a video call or voice call with our partner doctors, please inform the doctor, and availability will depend on each doctor's schedule when contacted.
  3. Your balance will be deducted as soon as the chat screen appears on your phone and when you are connected with the doctor. The duration of the chat session with the doctor ranges from 30 minutes to 1 hour, starting from the beginning of the conversation or until you or the doctor ends the session.
  4. During the chat session, you can send images related to your medical condition to the doctor in PNG, JPG, or bitmap format.
  5. After the Doctor's Consultation session ends, the doctor may provide a Medical Resume and Prescription (if required) in digital or electronic format. The medical resume contains a summary of the activities and results of the chat session with the doctor, as well as advice regarding your medical condition. A prescription is a written instruction from the doctor to the pharmacist or you about the medication prescribed for a specific medical condition.
  6. The doctor may conduct a follow-up with you to monitor your health condition after the chat session.
  7. Transactions cannot be canceled once the chat session with the doctor has been completed.
  8. We reserve the right to block or cancel your account in the event of abuse of the Doctor Consultation feature.
  9. Your doctor may provide a Doctor Referral for your reference.
  10. The fee charged includes Value Added Tax (VAT).
  11. The accuracy of the information in the Medical Resume and Drug Prescription depends on the information you provide to the doctor. Every content and statement in conversations with doctors through video calls, voice calls, and chat features on the Platform is a personal interaction between you and the partner doctor as a healthcare service provider.

 

6. Coupon Code Usage 

  1. By using a coupon code, you agree to comply with our terms and conditions regarding its usage. 
  2. Coupon codes are non-transferable and cannot be exchanged for cash. 
  3. Discounts provided by coupon codes cannot be claimed or modified once the purchase and payment have been confirmed by us.
  4. Each coupon code is valid for a specific period. Please check each coupon you receive to ensure its validity. 
  5. We reserve the right to terminate any coupon code at our sole discretion at any time.
  6. We also reserve the right, without prior notice, to cancel the use of a coupon code if there is any indication of fraud or violation of these terms and applicable laws in the Republic of Indonesia. In such cases, we will not provide any form of compensation.

 

7. Intellectual Property Rights

  1. We hold the license for the Ai Care name, icon, and logo, protected under the copyright and trademark laws of the Republic of Indonesia. You are prohibited from using, modifying, or displaying these names, icons, logos, or marks without our written consent.
  2. All intellectual property rights within this Platform are protected under the laws of the Republic of Indonesia, including ownership of all source code and related rights. You are prohibited from violating these intellectual property rights by modifying, creating derivative works, adapting, duplicating, copying, selling, reverse engineering, or exploiting the platform. This includes unauthorized use, employing automated programs or scripts, or any other method that might disrupt the platform's operation or performance, or alter its navigation structure or presentation of content.
  3. You are only allowed to use this platform for personal needs and may not transfer such usage rights to other parties.
  4. We reserve the right to take legal action against any infringement of intellectual property rights related to the Platform committed by you.

 

8. Advertisements 

The Platform may contain advertisements for products and/or services provided by third parties (Advertisements). All information regarding advertisements is provided by the advertiser. We do not endorse any advertisement. Your communications or transactions with advertisers and any terms, conditions, warranties, or representations associated with such transactions are solely between you and the advertiser.

 

9. Notifications

  1. All notices or requests for information to or about us will be processed. If you wish to submit a notice in writing, please send it to our address at PT Atmatech Global Informatika, The East Building Lt.12, Unit 06, Jl Dr. Ide Anak Agung Gde Agung Kav E.3.2 No.1, South Jakarta, or by email to hello@ai-care.id.
  2. All notices and requests to or about you will be processed if hand-delivered, sent by courier, registered mail, or to the email address you provide to us. Alternatively, you may also post such notices or requests on the Platform where they can be accessed by the public without charge. Notices to you will be deemed received if:
    • We can demonstrate that the notice, whether in physical or electronic form, has been delivered to you; or
    • We have posted the notice on the Platform, which is publicly accessible without charge.

 

10. Platform Functions

We are committed to ensuring the continuous smooth operation of our platform. Please be advised that our platform and service features may become temporarily unavailable due to necessary maintenance or technical issues, which are beyond our control.

 

11. Closing 

  1. These Terms of Use shall be governed by, construed, and enforced under the laws of the Republic of Indonesia. You expressly agree that the provisions of Article 1266 of the Civil Code and other provisions requiring court authorization or approval to terminate the Terms of Use do not apply to these Terms of Use.
  2. Disputes arising in connection with these Terms of Use will be resolved through deliberation for consensus or the Indonesian National Arbitration Board (BANI), following the applicable procedures at BANI. If both parties do not reach an agreement to resolve the dispute at BANI, then the dispute will be resolved through legal channels.
